Terms of Service

These Terms of Service ("Terms") govern your use of the Firedash platform, including our mobile apps for iOS and Android, our web dashboard at app.firedash.io, and our station touchscreen display (together, the "Service"). Please read them carefully before using the Service.

Who we are

The Service is provided by Tadej Korošak s.p., a sole proprietorship registered in Slovenia at Slovenskogoriška cesta 5, Ptuj ("Firedash", "we", "us"). You can reach us at [email protected].

The Service

Firedash is a real-time operational platform for fire brigades. It provides tools for connected-device control, incident management, crew coordination, automation workflows, fire-plan and facility records, and related reporting. The Service is provided on a software-as-a-service basis and may evolve over time as we add, improve, or discontinue features.

Important safety disclaimer

Firedash is an operational and coordination tool and is not a substitute for official emergency dispatch, the public emergency telephone (112 in Slovenia and the EU), or any legally mandated alerting system. Do not rely on Firedash alone for life-safety decisions or to dispatch emergency services. You are responsible for using Firedash in accordance with your brigade's standing operating procedures and applicable law.

Eligibility and accounts

To use the Service you must be at least 16 years old and authorized by your brigade to use Firedash. Accounts are typically created by your brigade administrator. You are responsible for keeping your credentials confidential, for all activity on your account, and for notifying us promptly if you suspect unauthorized access.

Brigade agreement

Most users access Firedash as members of a fire brigade or fire-safety organization (the "brigade") that has entered into a service agreement with us. In that case, the brigade's agreement governs pricing, provisioning, data retention within its tenant, user management, and permitted use at the brigade level. These Terms apply to you personally as an end user. Where the brigade's agreement conflicts with these Terms on a commercial matter (such as fees or term), the brigade's agreement prevails.

Acceptable use

You agree not to (a) use the Service for any unlawful purpose or in violation of your brigade's internal rules; (b) attempt to gain unauthorized access to the Service or to other users' data; (c) interfere with the Service, reverse engineer it, or circumvent any rate limits or security controls except to the extent permitted by applicable mandatory law; (d) upload malware or content that infringes another party's rights; (e) use the Service to send unsolicited communications; or (f) resell or sublicense the Service without our written consent.

Your content

You retain ownership of any content you or your brigade submit to the Service (incident records, messages, files, photographs). You grant us a limited license to host, process, and display that content solely to deliver the Service and to comply with law. The brigade is the data controller for operational content; see our Privacy Policy for details on roles and data handling.

Intellectual property

The Service, including its software, designs, text, graphics, and the Firedash name and logo, is owned by Firedash or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose while your account is active.

Third-party services

The Service integrates third-party components — Apple Push Notification service, Firebase Cloud Messaging, Firebase Analytics and Crashlytics, Google Maps SDK, Postmark, Cloudflare, and our cloud-hosting providers. Your use of those components is also subject to their respective terms. We are not responsible for third-party outages or changes beyond our reasonable control.

Fees and payment

Firedash is provided to brigades under a written service contract. The mobile app does not offer in-app purchases. Any fees, billing cycles, and payment terms are set out in the brigade's service contract. Late payment may result in suspension of the Service in accordance with that contract.

Service availability

We aim to make the Service available with high reliability, but we do not guarantee uninterrupted availability. Scheduled maintenance, emergency maintenance, force-majeure events, third-party outages, and internet-connectivity issues may cause downtime. We will use reasonable efforts to provide advance notice of planned maintenance.

Suspension and termination

You may stop using the Service at any time; your brigade administrator can remove your account. We may suspend or terminate your access (a) immediately if you breach these Terms in a way that affects security, lawfulness, or other users; (b) with reasonable notice if your brigade's service contract ends or fees remain unpaid; or (c) if we discontinue the Service, in which case we will give reasonable notice. Upon termination, your right to use the Service ends, and we will delete or return data in line with the Privacy Policy and the brigade's contract.

Warranty disclaimer

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions this section applies to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, Firedash is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or related to the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for all claims arising from or related to the Service in any 12-month period is limited to the fees paid by the brigade for the Service in that period, or, if no fees have been paid, one hundred euros (EUR 100). Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be limited under Slovenian law.

Indemnification

You agree to indemnify and hold Firedash harmless from claims, damages, and reasonable costs (including attorneys' fees) arising from your misuse of the Service, your breach of these Terms, or your violation of any applicable law or third-party right.

Privacy

Our collection and use of personal data is described in our Privacy Policy. By using the Service, you acknowledge you have read and understood that policy.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify affected users by email or through the Service at least 30 days before the changes take effect, unless a shorter period is required by law. Continuing to use the Service after the changes take effect means you accept the updated Terms.

Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Slovenia, excluding its conflict-of-law rules. The courts of Slovenia have exclusive jurisdiction over any dispute arising out of or related to these Terms, except that consumers (if any) retain the right to bring proceedings in the courts of their country of residence and to benefit from the mandatory provisions of their local law.

Severability and entire agreement

If any part of these Terms is found unenforceable, the remainder remains in effect. These Terms, together with the Privacy Policy and any brigade service contract, constitute the entire agreement between you and Firedash regarding the Service.
